THIS AGREEMENT made on the 09.05.2013
between the Mayor, Kakonhat Pourashava, Godagari, Rajshahi (hereinafter
called “The Employerâ€) of the one part and E.H.
& F.U (JV), A/102, Upashahar, Sopura,Boalia, Rajshahi.(hereinafter called
“the Contractorâ€) of the other part.
WHEREAS the Employer invited Tenders for
certain works, viz, a) Development of earthen road by B.C start from
Mission more Mariapara to Jowai B.C road
via Mr. Alamgir\'s house at Sursunipara
with 1 no. cross drain at chainage 590m and palisading work at ch. 575m under
kakonhat pourashava. Chainage :- 0.00 m to 1656.00 m
b)Development
of Earthen road by B.C start from Sherapara Moulovipara more of kakonhat
Godagari road to Mr. shaiful\'s house with 2 nos cross drain at chainage 04m and
254m under kakonhat pourashava.Chainage :- 0.00m to 560.00m
c)
Development of Earthen road by B.C start from joykrishtopur more toMr. Haren\'s
house at adhibashipara with 1 no. cross drain at chainage 122 under kakonhat
pourashava. Chainage :- 0.00 m to 581.00 m
d)
Development of Earthen road by B.C start from
Mr. Mojammel\'s house at panchgachia village to Mr. Akbor\'s house with 2
nos. cross drain at chainage 102m and 283m and
palisading work at ch. 096m & 268m under kakonhat pourashava. Chainage
:- 0.00 to 493.00m

Development of Earthen road by B.C start from Mohadevpur more to Tilahari more
via Muralipur village with 2 nos. cross
drain at chainage 409m and 1149m & palisading work at ch. 646m under
kakonhat pourashava. Chainage :- 0.00 to 1542.00m
f) Development
of Earthen road by B.C start from Baidapara more of Rajshahi Kakonhat
highway to adhibashipara B.C. road with
1 no. cross drain at chainage 300m and palisading work at ch. 301m under
kakonhat pourashava. Chainage:- 0.00 to 525.00m Package no
UGIIP-II-3/KAKO/UT/01/2012 , and has accepted a Tender by the contractor for
the execution of those works in the sum
of Taka Tk. 3,37,90,885.57 (Three crore
thirty seven lac ninety thousand eight hundred eighty five taka and fifty seven
paisa) only (hereinafter called “the contrac priceâ€).
NOW THIS
AGREEMENT WITNESS AS FOLLOWS:
1.
In this Agreement words and
expressions shall have the same meanings as are
respectively assigned to them in the General
Conditions of Contract hereafter referred
to.
2. The documents forming the Contract shall be
interpreted in the following order of
priority.
(a)
the signed Contract Agreement;
(b)
the Notification of Award;

(c)
the completed Tender Submission
Sheet as submitted by the Tenderer;
(d)
the Particular Conditions of
Contract;
(e)
the General Conditions of Contract;
(f)
the Technical Specifications;
(g)
the General Specifications;
(h)
the Drawings;
(i)
the priced Bill of
Quantities and the Schedules; and
(j)
any other documents listed in the
PCC as forming part of the Contract.
3. In
consideration of the payments to be made by the Employer to the Contractor
as hereinafter mentioned, the
Contractor hereby covenants with the Employer to
execute and complete the works and to
remedy any defects therein in conformity
in all respects with the provisions of
the Contract.
4. The Employer hereby covenants to pay the
Contractor in consideration of the successful
execution and completion of the works
and the remedying of defects therein, the
Contract Price or such other sum as may
become payable under the provisions of the
Contract at the times and in the manner
prescribed by the Contract.
